Terms & right of withdrawal

This translation is provided for convenience; the German version is legally binding.

1. Scope

These terms apply to the use of FreeMealTracker, operated by webhead GmbH.

2. Services

The basic features (diary, food search, calorie budget, reports) are free of charge. Premium additionally includes logging by photo and description using AI, up to a daily allowance (30 analyses). All values are estimates. The app does not replace medical advice and is not intended as the basis of a diet for minors, during pregnancy or breastfeeding, or for people with eating disorders.

3. Price, payment, term, cancellation

Premium costs 5 € per month including VAT and is billed monthly in advance via Stripe. The subscription renews for one month at a time and can be cancelled at any time, effective at the end of the paid month, without giving reasons, via “Cancel contracts here” or by email.

4. Account

You can delete your account at any time. An active subscription ends immediately; time already paid for is not refunded unless you have withdrawn from the contract. We may suspend accounts in case of misuse.

5. Foods shared by users

If you “share a food with everyone”, you grant us the free, perpetual and non-exclusive right to make its name, brand, barcode and nutritional values available to all users. Your name or email address is never shown. Please only enter values from the packaging. We may review, correct, hide or delete entries; entries with several reports are hidden automatically. If you withdraw the sharing or delete the entry, it also disappears for others. If you delete your account, shared entries remain without any link to you.

6. Liability

We are not liable for the consequences of decisions based on the app’s estimates, except in cases of intent or gross negligence and in cases of personal injury.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (webhead GmbH, Kärntner Ring 10/13, 1010 Wien, Österreich, contact form) of your decision by means of a clear statement (e.g. via the contact form or by letter). To meet the deadline, it is sufficient to send your notice before the withdrawal period expires.

Effects of withdrawal: We will refund all payments received from you without undue delay and at the latest within fourteen days, using the same means of payment. If you requested that Premium begin during the withdrawal period, you pay a reasonable amount corresponding to the proportion of the service already provided up to the withdrawal.
